1. Scope of Services

Emmerson Lumber is a full-service building supply yard providing lumber, hardware, building supplies, kitchen design, home and cottage design and plans, deck and dock construction support, equipment rentals, and related products, services, or information as described on its website or through its communications channels.

All offerings are subject to availability and may be modified, suspended, or discontinued at any time without prior notice. Product descriptions, pricing, and availability shown online are for general information and may differ from in-yard availability. Pricing and terms for actual purchases are governed by our Terms of Sale.

Unless expressly stated in writing, no information provided by us — including home and cottage design plans, project guides, or product recommendations — constitutes professional, legal, engineering, or architectural advice. Design and drafting services are provided for general project planning and do not replace review by a licensed professional where required by applicable building codes or law.

2. Eligibility

You must be at least 18 years of age to use our services unless otherwise permitted by applicable law or with the consent of a parent or legal guardian.

By using our services, you represent that you meet all applicable eligibility requirements.

3. User Responsibilities

You agree to:

• Provide accurate, current, and complete information, including on credit and contractor account applications
• Use the website and services only for lawful purposes
• Not interfere with or disrupt the operation of the website or services

We reserve the right to suspend or terminate access, including house accounts, for violations of these Terms.

4. Orders, Deliveries, Credit Accounts & Payments

Where applicable, orders, quotes, delivery scheduling, design and drafting fees, rental agreements, pricing, payment terms, cancellation policies, refunds, deposits, and fees will be disclosed at the time of transaction and are incorporated into these Terms by reference, along with our published Terms of Sale.

Contractor, trade, and house (credit) accounts are subject to approval by our credit manager and may be subject to additional written terms, including monthly statement and payment obligations.

Failure to comply with stated terms may result in cancellation, forfeiture of payments, or refusal of future service.

5. Electronic Communications

By using our website or services, you consent to receive communications from us electronically, including email, phone calls, and text messages, subject to your preferences and applicable law.

Electronic communications satisfy any legal requirement that such communications be in writing.

6. Text Messaging

Where you have provided express consent, we may send text messages regarding orders, deliveries, account activity, or appointment reminders. Consent to receive text messages is not implied, is not pre-selected, and is not a condition of purchase.

You may opt out at any time by replying STOP to any text message, or by contacting us using the details in Section 13. Message and data rates may apply according to your wireless carrier plan, and wireless carriers are not liable for delayed or undelivered messages.

7. Intellectual Property

All content on the website, including text, graphics, logos, trademarks, images, design plans, and software, is the property of Emmerson Lumber Limited or its licensors (including Castle Building Centres) and is protected by applicable intellectual property laws.

Our website may contain links to third-party websites or services, including contractor referral listings, our online hardware storefront, and rental or supplier partners. We are not responsible for the content, policies, or practices of third parties.
